I am here to persuade you that our Constitution is something extraordinary, something to revere.&#8221;<\/p><\/blockquote>\n<p>So waxed our great defender of the Constitution, U.S. Supreme Court Justice Antonin Scalia, even as a <a href=\"http:\/\/www.hattiesburgamerican.com\/news\/stories\/20040408\/localnews\/196951.html\">federal marshal was seizing reporters&#8217; tape recordings of the speech<\/a>.  The marshal claims that Scalia didn&#8217;t want the event recorded, but according to the story that announcement was never made at the event.<br \/>\nThe incident raises a couple questions:  First, why does Scalia refuse to allow his remarks to be recorded?  Is he that prone to make comments which would come back to haunt him?  And second, why are marshals, who are supposed to be providing <i>protection<\/i> doing Scalia&#8217;s dirty work and seizing tapes?<br \/>\nThe Reporters Committee for Freedom of the Press is <a href=\"http:\/\/www.guardian.co.uk\/worldlatest\/story\/0,1280,-3957180,00.html\">protesting the incident<\/a> as a violation of the Privacy Protection Act.<\/p>\n","protected":false},"excerpt":{"rendered":"<a href=\"http:\/\/www.brianarner.com\/weblog\/2004\/04\/destroying_the_record\/\" rel=\"bookmark\" title=\"Permalink to Destroying the Record\"><p>&#8220;You may wonder what makes our Constitution so special.
